Superior Court Affirms Summary Judgment in Favor of Defense in Premises Liability Claim
The Pennsylvania Superior Court recently entered an Order affirming an award of Summary Judgment in favor of Attorney Decker's client, a snow plowing contractor. Mr. Decker argued that his client was protected from liability by the "Hills and Ridges" doctrine since the accident occurred during an ongoing snow event, and the Superior Court agreed. Further, the appellate court agreed the plaintiff had waived any argument that the defendant was liable under the snow removal contract between the contractor and the private landowner.
