Summary Judgment Granted in Favor of Snow Removal Company

Attorney Decker recently secured summary judgment in favor of a Snow Removal Company in the Erie County Court of Common Pleas.

The plaintiff alleged that she sustained serious personal injuries from falling on black ice while entering her vehicle outside an apartment building.  The plaintiff sued the Apartment Complex, and the Snow Removal Company was joined as an additional defendant.

Attorney Decker argued that the Snow Removal Company was not obligated to remove snow and ice between the vehicles in the parking lot, and the records indicated that the Company had salted the lot approximately 3 hours before the plaintiff’s fall.  The Court also denied the Apartment Complex’s indemnity claim, ruling that the Snow Removal Company was not contractually obligated to service the area between the vehicles.
