Successful Defense of Commercial Landlord in Arbitration

Attorney Decker recently won another defense verdict for a commercial client in Erie County arbitration.  The parent of a minor filed a suit against her landlord, asserting that the minor sustained permanent scarring when a glass pane fell out of the front door at the entrance of the apartment.  The plaintiff claimed the property owner was negligent in the care and maintenance of the property and should have had safety glass installed in the door.

The defense argued there was no notice of any allegedly defective condition, and denied any negligence in the maintenance of the property.

The defense also argued that the injury could not have happened as the plaintiff claimed given the construction of the door.

The panel returned a verdict in favor of the defendant on all claims.
