Favorable Verdict Secured in Auto Accident Compulsory Arbitration
Attorney Decker recently secured a favorable verdict in a Compulsory Arbitration in Erie County. The plaintiff was a passenger in a vehicle that was involved in a low speed rear end collision. The plaintiff alleged that she sustained significant neck, back and radicular symptoms as a result of the accident. The defense conceded liability but disputed that the accident was the cause of the plaintiff’s injuries. The defense argued that the plaintiff had a twenty year history of prior significant orthopedic problems and was involved in other accidents as well.
The arbitration panel awarded minimal damages to the plaintiff.
