Defense Verdict in Erie County Non-Jury Trial

In August, Attorney Schumacher secured a defense verdict for a husband and wife who were sued for an alleged breach of contract case in Erie County. The defendants contracted with the plaintiff to stable a horse on the plaintiff's property. After the horse was removed from the property, the plaintiff alleged it had done significant property damage and claimed the contract required reimbursement of the cost of repairs. The Judge disagreed, finding the contract ambiguous with respect to any property damage, and awarded zero damages to the plaintiff.
