Construction Businesses Allowed to Reopen on Limited Basis Starting May 8, 2020
On April 20, 2020 the Governor and Secretary of Health amended their previously issued Business Closures Orders to permit in-person “limited construction activity” beginning May 8, 2020. The Amendments are linked at the bottom of this Alert.
The previously issued Life Sustaining Business FAQs have been amended to reflect that construction is permitted beginning May 8, 2020, but the FAQs do not detail what “limited construction activity” entails. The updated FAQs are linked below in this Alert.
While the scope of “limited construction activity” is undefined, it is clear that whatever construction activities are permitted must be performed in accordance with Safety Measures dictated by the State. A previous Alert described the Department of Health’s workplace safety order, which would apply to permitted limited construction activities. Notably, that Order requires all workers to wear masks and practice social distancing, regardless of whether working indoors or outdoors. The only exceptions to the mask mandate are when: (1) the mask impedes the employee’s vision, (2) the employee has a medical condition that prohibits wearing a mask, or (3) wearing a mask would create an unsafe condition in which to operate equipment or execute a task.
