How should Terms and Conditions be provided to a customer?
Terms and conditions may be provided to a customer in a number of ways, including in physical paper form, via an app, or by posting the terms and conditions online for viewing. Terms and conditions can be incorporated by reference in a quotation, a purchase order, or other document without being fully set forth in those documents, so long as the reference is reasonably conspicuous. Best practice, however, is to actually furnish the terms and conditions to the customer along with the quotation or offer, either in hard copy or electronically.
