Do probationary employees have the same rights as regular employees?
In Pennsylvania, the general rule of law is that employees are "at-will," meaning that they can be terminated for a good reason, a bad reason, or no reason at all. There are three exceptions to the at-will employment doctrine: (1) individual and collective bargaining agreements, (2) public policy wrongful discharge causes of action, and (3) discrimination claims. Typically, probationary employees are not eligible for certain benefits, such as group insurances, vacations, and other employer-created benefits. However, all of the restrictions on the treatment of employees, including discharge of employees, apply equally to probationary and non-probationary employees.
